CosmilThese terms govern your use of the Cosmil application and the cosmil.app website (together, "Cosmil," "we," "us"). By purchasing, downloading, or using Cosmil, you agree to them. If you don't agree, don't use Cosmil.
Your license
Cosmil is licensed, not sold. When you purchase a license, we grant you a personal, non-exclusive, non-transferable license to install and use Cosmil on up to the number of Macs your license tier allows. The license is for you (or, for multi-Mac tiers, your household or the individuals you purchased it for) — it is not a site license or a license to redistribute.
You agree not to:
- Share, publish, resell, or transfer your license key
- Circumvent or attempt to circumvent license verification or activation limits
- Reverse engineer, decompile, or modify the app, except where applicable law expressly permits it despite this restriction
- Redistribute the app, in original or modified form
- Use Cosmil for any unlawful purpose
We may suspend or revoke license keys involved in fraud, chargebacks, key sharing, or other violations of these terms. Where the situation allows, we'll contact you before doing so.
Payments and refunds
For non-commercial purposes, licenses are a one-time purchase, processed by Stripe. Prices are listed on the pricing page and may change at any time; changes don't affect licenses already purchased.
If Cosmil isn't for you, email [email protected] within 14 days of purchase and we'll refund you in full. Refunded licenses are deactivated. Refund requests after the 14-day window are at our discretion.
If you dispute a charge with your bank instead of contacting us first, we may deactivate the associated license while the dispute is resolved.
Updates and availability
Your license includes app updates as we release them. We work hard on Cosmil and intend to keep improving it, but we don't guarantee any particular update, feature, or release schedule, and features may change or be removed between versions. License activation and update delivery depend on our servers, which we aim to keep available but don't guarantee to be uninterrupted.
Intellectual property
Cosmil, its code, design, name, and all related materials are and remain our property. These terms grant you a license to use the app — nothing in them transfers any ownership to you. Your files, of course, remain entirely yours; Cosmil never claims any rights over the content you manage with it.
Privacy
Our Privacy Policy describes what data we handle and how. It forms part of these terms.
Disclaimer of warranties
Cosmil is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that Cosmil will be error-free or uninterrupted, or that it will meet your requirements.
Cosmil is a file manager: it moves, copies, and deletes files at your direction. You are responsible for maintaining backups of your data. Some jurisdictions don't allow the exclusion of implied warranties, so some of the above may not apply to you.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of (or inability to use) Cosmil — even if we've been advised such damages are possible. Our total liability for any claim relating to Cosmil is limited to the amount you paid us for your license.
Termination
You can stop using Cosmil at any time. We may terminate your license if you materially breach these terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — do survive.
Changes to these terms
We may revise these terms from time to time; the current version will always live at this page with its date at the top. Material changes will be noted here, and your continued use of Cosmil after a change takes effect constitutes acceptance of the revised terms.
General
These terms are the entire agreement between you and us regarding Cosmil. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision isn't a waiver of it. These terms are governed by the laws of the United States and the jurisdiction in which we operate, without regard to conflict-of-law rules.
